ORDINANCE NO 19

AN ORDINANCE OF THE TOWNSHIP OF PINE, COUNTY OF INDIANA AND COMMONWEALTH OF PENNSYLVANIA, PROHIBITING THE SPRAYING OF ANY TREES OR VEGETATION ON TOWNSHIP ROADS AND RIGHTS OF WAY

BE IT ORDAINED AND ENACTED by the Supervisors of Pine Township, Indiana County, Pennsylvania, and it is hereby ordained and enacted as follows:

SECTION 1:  No person, firm, association, partnership or corporation shall spray with any chemical or insecticide any tree, shrubbery, woody plant or other vegetation in Pine Township, Indiana County, Pennsylvania.

SECTION 2:  Notwithstanding any language in this Ordinance, any person, firm, association, partnership or corporation shall have the right to spray chemicals or insecticides for agricultural purposes.  The use of such chemicals or insecticides shall be limited to spraying for crops.

SECTION 3:  Any person, firm, association, partnership or corporation violating Section 1 hereof shall be guilty of a summary offense and shall be punishable by a fine of no more than Three Hundred Dollars ($300.00) for each occurrence Each day that an offense occurs shall be treated as a separate offense and shall be subject to a fine of Three Hundred Dollars ($300.00) for each violation.

SECTION 4: This Ordinance shall be effective immediately.
