ORDINANCE NO. 27
An Ordinance of the Township of Pine, County of Indiana and Commonwealth of Pennsylvania, defining what types of activities by animals constitutes a nuisance and providing for penalties for violations thereof.

BE IT ORDAINED AND ENACTED by the Board of Supervisors of Pine Township, Indiana County, Pennsylvania, and it is hereby ordained and enacted as follows:
Section 1.       Person shall mean any individual, partnership, corporation or other entity.
Section 2. No person shall keep, own or harbor any animal in Pine Township, Indiana County, Pennsylvania, so as to create offensive odors, excessive noise or unsanitary conditions which are a menace to the health, comfort or safety of the public.
Section 3. No person shall allow any animal to habitually bark, howl, screech, yelp or bay in a manner which injures or disturbs the health, safety or comfort of any person.
Section 4. No person shall allow any animal that the person owns or has custody of to scratch, dig or defecate upon any lawn, tree, shrub, plant, building or any other public or private property, other than the property of the owner or person in charge or control of such animal. When the owner or person in charge or control of such animal removes any feces deposited by such animal and dispose of the same in a sanitary manner, shall not constitute a violation of this Ordinance.
Section 5. Any person with defective eyesight or hearing who relies upon a dog specifically trained for these purposes shall be exempt from the operation of the Ordinance. 
Section 6.       This Ordinance shall not apply to any farm animals or any animals that are utilized to assist in agricultural or farming operations.
Section 7. Any owner or person having control or custody of any animal which engages in any act that violates this Ordinance shall, upon conviction thereof, be sentenced to pay a fine plus costs, for each offense, of not less that One Hundred Dollars ($100.00) nor more that Three Hundred Dollars ($300.00) and in default of the payment thereof, shall undergo imprisonment for a period not exceeding ten (10) days.
