COOPERATIVE AGREEMENT FOR POLICE SERVICE ORDINANCE NO.50
AN ORDINANCE OF THE BOARD OF SUPERVISORS OF PINE TOWNSHIP, INDIANA COUNTY, PENNSYLVANIA, AUTHORIZING COOPERATION IN GOVERNMENTAL FUNCTIONS BETWEEN PINE TOWNSHIP AND CHERRY TREE BOROUGH, BOTH OF WHICH ARE MUNICIPAL SUBDIVISIONS OF THE COMMONWEALTH OF PENNSYLVANIA IN THE COUNTY OF INDIANA.

WHEREAS, the Board of Supervisors of the Township of Pine, of the County of Indiana and
Commonwealth of Pennsylvania (the “Township”) deems it to be in the public interest to enter into
a cooperative agreement with The Borough of Cherry Tree, of the County of Indiana and
Commonwealth of Pennsylvania (the “Borough”), pursuant to which the Borough will provide police
services by its employed police officers to the Township on specified terms and conditions; and

WHEREAS, the power to enter into such an agreement is granted by the Constitution of the
Commonwealth of Pennsylvania, Article 9, Section 5, et seq.; the Pennsylvania Inter-governmental
Cooperation Law, 53 Pa.C.S. § 2301 et seq. and particularly 53 Pa.C.S § 2303, Intergovernmental
cooperation authorized, and 53 Pa.C.S § 2304, Intergovernmental cooperation; and the Pennsylvania
Second Class Township Code, 53 P.S. § 65101 et seq. and specifically 53 P.S. § 66507,
Intergovernmental cooperation, and 53 P.S. § 66903, Contracts to secure police service; and

WHEREAS, pursuant to 53 Pa.C.S. § 2307, Content of ordinance, the Township shall adopt
an Ordinance specifying certain terms of the agreement;

NOW, THEREFORE,  PINE TOWNSHIP, INDIANA COUNTY, PENNSYLVANIA
HEREBY ENACTS AND ORDAINS the following Ordinance:

1.  The Board of Supervisors of the Township is hereby authorized and directed to enter into
an agreement (the “Agreement”) with the Borough for the provision of police services to the
Township by the employees of the Borough, and any such modifications of the Agreement as may
be agreed to by the Township and the Borough.

2.  The conditions of the Agreement shall be that the Borough shall provide police service
to the Township by the employees of the Borough, upon terms and conditions to be specified by the
Agreement.  Upon the due execution of the Agreement by all parties, the police officers of the
Borough shall have all the powers and authority conferred by law on police officers in the Township.

3. The Agreement shall continue in effect until terminated upon terms and conditions as
specified by the Township and the Borough in the Agreement.

4.  The purpose and objective of the Agreement are to provide police service to the Township
on a cost-effective basis, it being recognized by the Township that its resources do not permit it to
operate its own police department and to employ officers for that purpose.

5.  The Township shall compensate the Borough for the police services to be provided by
payment from the general funds of the Township.

6.   The Agreement shall be implemented by the Board of Supervisors of the Township and
the governing body of the Borough.

7.  The Township does not contemplate that it shall acquire, manage, license or dispose of
real or personal property pursuant to the Agreement.

8.  The persons providing police services hereunder shall for all purposes be deemed to be
employees of the Borough, which shall be solely empowered to enter into contracts for policies of
group insurance and employee benefits, including Social Security, for its employees.

9.  In the event any provision, term or condition of this Ordinance shall be held to be invalid
for any reason, such invalidity shall not affect or impair any remaining provision, term or condition
of this Ordinance, it being the intent of the Township that the remainder shall be and remain in full
force and effect to the fullest extent possible.

10.  All ordinances or part of ordinances inconsistent with this Ordinance are hereby repealed.

11.  This Ordinance shall become effective five (5) days after enactment hereof, as provided
by law.
